Art. 1 - Subject Matter

1.1 These general terms and conditions represent access to and use of the Site bandbangel.com (hereinafter the "Site"), are activities regulated by these general terms and conditions.

1.2 The Site is owned by Ruza Anic, C.F. NCARZU59A43Z149L (hereinafter the "Owner").

1.3 Access to the Site and its use presupposes the reading, knowledge, and acceptance of these general terms and conditions.

1.4 Use of the Site is permitted only for users of at least 18 years of age. If you are under 18 years old, you are not permitted to register on the site without permission from your parents.

1.5 Use of the site is also governed by:

• Privacy Policy, which governs the terms under which personal data we collect from you or that you provide to us are used. By using the Site, you consent to the use of your personal data and guarantee that the personal data provided is accurate.
• Cookie Policy, which contains information regarding cookies used on the Site.

Art. 2 - Modifications to Terms of Use

2.1 The operator may modify or simply update, in whole or in part, these general terms and conditions. Modifications and updates to the general terms and conditions will be notified to users on the Home page as soon as they are adopted and will be binding as soon as they are published on the Site in this same section. Access to and use of the Site presupposes acceptance by the user of these terms and conditions.

Art. 3 - Intellectual Property

3.1 The contents present on the Site, such as, by way of example, works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, published on the Site itself, including menus, web pages, graphics, colors, schemes, tools, fonts and the design of the Site, diagrams, layouts, methods, processes, functions and software that are part of the Site, are protected by copyright and any other intellectual property rights of the Site or of any third parties contracted by it. Reproduction, in whole or in part, in any form, of the Site and its contents is prohibited without the express written consent of the Owner.

3.2 The user is authorized only to view the Site and its contents by enjoying the related services available there. The user is also authorized to perform all other temporary acts of reproduction, devoid of their own economic significance, which are considered transitory or accessory, an integral and essential part of the same viewing and enjoyment of the Site and its contents and all other navigation operations on the Site that are performed only for legitimate use of the same.

Art. 4 - Use of the Site and User Responsibility

4.1 Access to and use of the Site, viewing of web pages, including communication with the operator, constitute activities conducted by the user exclusively for personal uses unrelated to any commercial, business, or professional activity.

4.2 The user is personally responsible for the use of the Site and its contents. The operator cannot be held responsible for non-compliant use with current laws, of the Site and contents by each of its users, except for responsibility for willful misconduct and gross negligence. In particular, the user will be the sole and only responsible for the communication of incorrect, false, or third-party information and data without their expressed consent, as well as in consideration of incorrect use of the same.

4.3 Any material downloaded or otherwise obtained through the use of the service is at the user's choice and risk, therefore any responsibility for any damage to computer systems or loss of data resulting from download operations falls on the user and cannot be attributed to the operator.

4.4 The operator disclaims any responsibility for any damage resulting from inaccessibility to services present on the Site or from any damage caused by viruses, corrupted files, errors, omissions, service interruptions, content deletions, network-related problems, providers or telephone and/or telematic connections, unauthorized access, data alterations, failure and/or defective operation of the user's electronic equipment.

4.5 The user is responsible for the custody and correct use of their personal information, including credentials that allow access to reserved services, as well as any harmful consequence or prejudice that may result to bandbangel.com or third parties following incorrect use, loss, or theft of such information.

4.6 The Operator has taken every reasonable precaution to prevent the publication on the Site of contents and images that may be considered harmful to decorum, human rights, and the dignity of persons, in all possible forms and expressions. In any case, should the aforementioned contents be considered harmful to religious or ethical sensitivity or decorum, the interested user is asked to communicate this condition to the operator, which however warns that any possible access to contents considered harmful or offensive occurs by the user at their sole discretion and at their exclusive and personal responsibility.

5.1 As indicated previously, the operator performs with the utmost diligence the care and maintenance of the Site and its contents, however, it assumes no responsibility for the correctness, completeness, and timeliness of the data and information provided on the Site or on sites linked to it. Therefore, all responsibility for errors or omissions resulting from the use of data and information on the Site must be excluded.

5.2 The operator disclaims all responsibility, including the presence of errors, correction of errors, responsibility of the server hosting the Site; it is also not responsible for the use of the information contained, their correctness and reliability. In no case, including negligence, shall the Owner be responsible for any direct or indirect damage that may result from the use, or inability to use, the materials present on the Site.

Art. 6 - Limitations on Service Provision

6.1 The operator cannot be held responsible for damages resulting from failure to provide the service due to incorrect or failed operation of electronic communication means for reasons beyond the scope of its foreseeable control. By way of example, but not exhaustively, malfunction of servers and other electronic devices not forming an integral part of the Internet network, malfunction of installed software, computer viruses on any presence of viruses or other harmful and damaging computer components, as well as actions by hackers or other users having access to the network. The user therefore undertakes to hold harmless and indemnify the Owner from any responsibility and/or request in this regard.

Art. 7 - Links to Other Sites

7.1. The Site may contain hyperlinks to other websites that have no connection with it. The operator does not control or monitor such websites and therefore does not guarantee their contents or data management in any way. The user must therefore carefully read the terms of use of third-party sites visited and their respective privacy policies, as these terms of use and privacy policy refer solely to this Site.

Art. 8 - Links on Other Websites

8.1 This Website may also be accessed through third-party websites where a link or banner will be present to access the Site.

8.2 The activation of links on third-party websites to this Website is only possible with prior consent and authorization from the manager, which can be requested by contacting them at the aforementioned address, or by writing to the email address: info@bandbangel.com.

8.3 The activation of unauthorized links will authorize the manager to take action for the immediate deactivation of illegal links and for any recognition of unfair commercial practice or unfair competition or action detrimental to the reputation and prestige of the manager, its services and the companies of the same group. In any case, the activation of deep hypertext links (such as deep frames or deep links) to the Site or the unauthorized use of meta-tags is prohibited.

Art. 9 - Trademarks

9.1 All trademarks and distinctive signs present on the Site, including those relating to individual activities carried out by the Owner, are the exclusive property of the Owner or the companies referred to by him.

9.2 The Owner has the right to make exclusive use of the aforementioned trademarks. Therefore, any use that is not permitted, not authorized and/or not in compliance with the law is strictly prohibited and entails legal consequences. It is in no way permitted to use said trademarks and any other distinctive sign present on the Site to improperly derive, even indirectly, advantage from the distinctive character or reputation of the owner's trademarks or in a way that prejudices them and their owners.

9.3 The domain bandbangel.com as well as its various declinations and subdomains are the property of the Owner. No use, even indirect, is permitted, except with specific written authorization from the Owner.

Art. 10 - Acceptable Use

10.1 Our acceptable use policy establishes all permitted and prohibited uses of this Website.

10.2 When using the Website, you must comply with this acceptable use policy.

10.3 You cannot access or use the Website for purposes other than those for which we make the Website and our services available.

10.4 The Website cannot be used in connection with commercial activities, except those that are specifically approved or endorsed by us.

10.5 As a user of this Website, you agree not to:

• Systematically retrieve data or other content from the Website to a database or compilation directory without our written permission;
• Make any unauthorized use of the Website, including collecting usernames and/or email addresses of users or sending unsolicited emails or creating user accounts under false pretenses;

• Implicitly imply a relationship with us or another company with which you have no relationship.

Art. 11 - Booking Terms

11.1 Booking methods: Booking can be made through our website with online payment, through booking platforms (Booking.com, Airbnb, Vrbo) or by contacting Angel B&B directly. To confirm the booking, it is necessary to complete registration and payment according to the chosen methods. In the case of booking through our website, payment must be made online at the time of booking or before arrival if we have sent you an online payment link. We cannot grant you access to the property until you have completed payment.

11.2 Double Booking Protection: In the event of a double booking due to a system error or oversight, Angel B&B will immediately notify the affected guest(s) and offer alternative solutions, including: (a) rebooking for alternative dates with a discount of 10% on the total booking amount; or (b) full refund of the booking amount. The guest will have 48 hours to choose their preferred solution. Angel B&B will cover any additional costs incurred by the guest due to the double booking error.

11.3 Payment methods: Payment methods are credit cards (VISA, Mastercard, American Express, UnionPay, Diners Club International, Discover, Google Pay and Apple Pay) or bank transfer.

11.4 Cancellation policy: Cancellations made 14 days or more before arrival receive a 90% refund. Cancellations made within 14 days of arrival receive a 50% refund. Please make the cancellation via email and check the cancellation acceptance. Booking platforms (Booking.com, Airbnb, Vrbo) may offer different cancellation policies.

11.5 Check-in and Check-out Times: At Angel B&B, check-in is from 14:00 and check-out is until 10:00. The guest is not authorized to stay beyond the dates of the booking. Any unauthorized stay beyond the checkout date will result in an immediate request to leave the property and report to local authorities.

11.6 Responsibility for Damage to Furnishings and Equipment: Guests are entirely responsible for any damage, breakage or deterioration of furnishings, equipment, objects and structures of the property caused during their stay. The cost of repair or replacement will be charged to the customer. Angel B&B reserves the right to retain the necessary amount from the security deposit or charge it directly to the payment method provided.

11.7 Protection Against Theft and Loss: Angel B&B is not responsible for theft, loss or damage to guests' personal belongings. Guests are invited to use the safe available in the room for valuables. The property is equipped with surveillance cameras in common areas. In case of reported theft, the guest must file a report with local authorities.

11.8 Smoking Ban: Angel B&B is a completely non-smoking facility. Smoking is prohibited in all indoor areas, including rooms, bathrooms and common areas. Violators will be subject to a fine of €250, which will be charged to the payment method provided.

11.9 Noise and Quiet Rules: Out of respect for other guests, noise must be kept at reasonable levels, especially between 22:00 and 08:00. Parties, unauthorized gatherings and assemblies are prohibited. Angel B&B reserves the right to ask guests to leave the property without refund in case of violation of this rule.

11.10 Ban on Events and Parties: Angel B&B does not allow parties, meetings, events or gatherings of any kind. The property is intended exclusively for tourist accommodation. Violations will result in immediate cancellation of the booking without refund and the guest will be asked to leave the property.

11.11 Unregistered Additional Guests: Only registered and paying guests may stay at the property. Unregistered additional guests are not permitted. Violations will result in immediate cancellation of the booking without refund and the guest will be asked to leave the property.

11.12 Cleaning and Maintenance: The property is cleaned daily. Guests are required to keep the apartment in hygienic and orderly conditions. In case of extraordinary cleaning necessary due to guest negligence, an additional cost of €50-150 will be charged depending on the extent of cleaning required.

11.13 Indemnification and Liability: Guests agree to indemnify and hold harmless Angel B&B from any legal claims, damages, losses or expenses arising from their conduct, negligence, violation of these terms and conditions or unlawful actions during their stay. This includes, but is not limited to, damages to third parties, personal injury or violations of local laws.

Art. 12 - Data Processing

12.1 User data is processed in accordance with the provisions of data protection regulations, as specified in the appropriate section containing the information pursuant to Art. 13 of EU Regulation 2016/679 (Privacy Policy). For more information, access the Site's privacy policy.

Art. 13 - Severability Clause

13.1 In the event that any of the clauses of these terms and conditions is null for any reason, this will not in any way compromise the validity and compliance of the other provisions contained in these terms and conditions.

Art. 15 - Applicable Law and Jurisdiction

15.1 These terms and conditions are governed by Italian law and interpreted in accordance with it. Consequently, the interpretation, execution and resolution of the terms and conditions are subject exclusively to Italian law.

15.2 Any disputes arising from or related to these terms and conditions must be resolved exclusively by Italian judicial authorities. In particular, if the buyer is a consumer, any disputes must be resolved by the court of Macerata in accordance with applicable law.
